Terms & Conditions

 These Terms & Conditions (“Terms”) govern all services provided by FiveStarReviewGuy, a business name registered under Superyacht Access Club Pty Ltd (ABN: 14084938081, ACN: 084938081), (“FiveStarReviewGuy”, "FSRG",  “we”, “our”, or “us”), to you (“the Client”, “you”).

By engaging our services via our website, email, or payment portal, you agree to be bound by these Terms.

 FiveStarReviewGuy (FSRG) provides review management and automation services, including:

• Google, TrustPilot & Product Review monitoring and consulting
• Automated email & SMS campaigns (SMS on a pay-per-use basis)
• Monthly reporting
• QR code creation
• Review monitoring & negative review alerts
• Data analysis reports
• Customer service coaching/training
• Additional services offered, from time to time, or added to the website 

All software systems used are owned or licensed by FiveStarReviewGuy and are not transferred to the Client.

• Services are either billed in 1 installment or month to month upfront, starting from the date of the initial payment (or after a trial month, if offered), and no refunds are provided once payment has been made. 
• Payments advertised on the FSRG website are month to month per franchise/location.
• Payments are processed via secure automatic debit using your provided credit card through our website (via third party companies Stripe or Link). Manual invoicing can be arranged on request at an additional 10% service charge for each request.
• All pricing is exclusive of GST, which will be added.

• Upon signup, you agree to either:
  • A month-to-month Executive plan, or
  • A commitment of one full payment, or monthly payments.
• Cancellation is available at any time after giving  30 days written notice (via email). Due to this 30 day advanced written notice you may be charged for one additional monthly payment during this period.  
• Payments will continue, charged month to month indefinitely until 30 days notice of cancellation is provided. This will usually be at the same rate but may be at a different rate based on any offers available at the time of your initial purchase.
• Cancellation requires written notice via email to David@FiveStarReviewGuy.com, and the service will end at the end of the current payment period. 

• Anyone can apply to be a Referrer and receive Referral Bonuses, however this bonus is not automatically applied. Sales people are encouraged to apply around Australia first before starting to refer any businesses to our services. To receive a referral bonus you must proactively be signed up with FSRG as a sales person to be eligible for any bonuses. Bonuses are not provided to a business as a discount, and are only provided to registered sales people through FSRG. • You will be registered as a Referrer and additional information will be required to complete the registration. Once registered, you'll be sent additional information about the sales role.
• You cannot earn any referral bonuses unless you register FIRST,  prior to any sale taking place with  FiveStarReviewGuy.com
• Payments to Australian referrers are made via bank Direct Deposit and International referrers via PayPal. 
• Payment are provided for the first 10 consecutive paid months if the client continues to make full payments to FSRG for 10 consecutive months. Referral bonuses do not exceed 10 consecutive months and do not continue if payments are discontinued. No further referral bonus will be paid after that time even if payments resume. 
• Payments are up to $100AUD monthly for the Enterprise pack (or 10% excluding GST , whichever is lower), and a maximum of up to $1,000AUD per location. If a discount on the original price has been made then the referral bonus is paid as 10% of the monthly total for the company (excluding GST). The payment of up to $100AUD is paid starting from the first month FSRG receives payment from a client and ends EITHER after 10 payments or prior to that if the client cancels their services with FSRG.
•  Payments are up to $50AUD monthly for the Business pack & Small Biz Pack (or 10% excluding GST , whichever is lower), and a maximum of up to $500AUD per location.   If a discount on the original price has been made then the referral bonus is paid as 10% of the monthly total for the company (excluding GST). The payment of up to $50AUD is paid starting from the first month FSRG receives payment from a client and ends EITHER after 10 payments or prior to that if the client cancels their services with FSRG.
• Payments to the referrer can take up to 28 days after payment is received from the Client. 

• As part of providing our services, we collect data including names, email addresses, and mobile numbers of your customers.
• This data remains stored within secure systems and is used solely to facilitate your review automation and related services.
• FiveStarReviewGuy does not share or sell customer data to any third parties.
• Upon request, for an additional fee, we may provide copies of your customer data collected through our services.

• We set a target goal of achieving a 4.9/5 review score and a minimum 250+ reviews above your current review numbers (with no upper limit). This target varies depending on your business/industry and may not be reached due to multiple factors outside of our control.
• Any statements or promises in any advertising, or on our website in relation to results, are only an estimate of possible returns on your investment with Five Star Review Guy and may not be a typical average result. Profit increases by using FSRG vary based on your type of business and how you and your staff actively apply the information and instructions in delivering the service from the Five Star Review Guy.
• After 12 months of service has been provided, FSRG will continue to provide services month to month until you choose to cancel. Any FREE services are not transferrable to another owner if the purchasing business is sold, and is not transferrable to another business opened by the owner who signed up to the original paid service. All packs can be cancelled at any time by the purchaser or FSRG should the service be changed, adjusted, or tampered with by the purchasing business, or if FSRG changes the offer, or if the FSRG business is closed  and/or no longer operating under that name, or due to any situations under the legal definition of Force Majeure which may hinder the service from continuing to be provided by FSRG.
• Promotional statements such as "Generate more reviews, customers & profit for only $10 a day (or $7 a day), (or for a few hundred dollars a month)"  is an estimated cost applying to multi-locations franchises, not including GST. Actual costs quoted may be higher for your business.
• Offers such as '2025 Loyalty Offer' provide a scaled reduction in costs that vary from client to client. Typically the first year is at a full rate or reduced agreed rate for multi-locations, the second year is half the standard advertised website price or stays at the reduced agreed price of the first year (whichever is lower), with 1 to 2 extra years provided for free (in all cases excluding GST).
• At each stage, services may vary or be reduced in line with the cost, however services do continue at a basic level such as maintaining Review Management and/or  Boomerang Promotions even during timeframes that my services are provided for free. FSRG solely determines the frequency, need and duration of any free services. 
• While every attempt is made to appeal to review sites to remove negative feedback, FSRG ultimately cannot guarantee the removal or suppression of negative reviews as these decisions rest with third-party platforms (Google, TrustPilot, ProductReview, etc).
• FiveStarReviewGuy is not liable for:
  • Any loss of data through error, accident, hacking, automation malfunction, or issues arising from third-party CRM integrations used by us.
  • Any consequential loss, lost profits, loss of customers, business interruption or indirect damages arising from using any of our services.

 You agree to indemnify and hold harmless FiveStarReviewGuy, its directors, employees, and contractors from any claims, losses, damages, costs or expenses arising out of:

• Your breach of these Terms, or our breach of these terms.
• Your misuse of our services, or our inability to provide services to your satisfaction.
• Any regulatory or legal issues resulting from your use of any services you pay for.

  These Terms are governed by the laws of New South Wales, Australia, and you agree to submit to the exclusive jurisdiction of the courts of New South Wales (or the appropriate courts within your state or territory if outside NSW). 

FiveStarReviewGuy may update these Terms & Conditions from time to time.

Continued use of our services constitutes acceptance of any updated terms.

 FiveStarReviewGuy retains a license to use aggregated, anonymised data for benchmarking or marketing purposes. We will not share your identifiable customer data with other clients or third parties without your express consent.
